Sec. 213. "Prime farmland", for purposes of IC 14-34 , has the meaning that is: (1) prescribed by the United States Secretary of Agriculture: (A) on the basis of factors such as moisture availability, temperature regime, chemical balance, permeability, surface layer composition, susceptibility to flooding, and erosion characteristics; and (B) for land that historically has been used for intensive agricultural purposes; and (2) published in the Federal Register.
