Sec. 15. (a) The department may assess a civil penalty of not more than ten thousand dollars ($10,000) against a person who violates section 1 or 2 of this chapter. (b) A person who knowingly or intentionally violates section 1 or 2 of this chapter commits a Level 6 felony if the violation relates to the operation of a Class II well. (c) A civil penalty assessed under this section shall be deposited in the oil and gas environmental fund established by IC 14-37-10-2 . IC 14-37-5 Chapter 5.
