Sec. 1. This article applies to the following: (1) A person who engages in surface coal mining operations, whether or not the person has a permit. (2) An agency, a unit, or an instrumentality of federal, state, or local government, including a publicly owned utility or publicly owned corporation of federal, state, or local government, that proposes to engage in surface coal mining operations.
