Sec. 13. The commission may acquire by appropriation under Indiana eminent domain law: (1) any land, property, rights, rights-of-way, franchises, easements, or other interests in real property, including land under water and riparian rights; or (2) any existing facilities, betterments, and improvements, or other property; necessary and proper for the creation, development, establishment, maintenance, or operation of a project or any part of a project.
