Acquisition of property by purchase or lease

Sec. 16. (a) The commission may acquire, by purchase or by lease: (1) any land, property, rights, rights-of-way, franchises, easements, and other interests in real property, including land under water and riparian rights; and (2) any existing facilities, betterments, and improvements; that the commission considers necessary or convenient for the establishment, development, construction, improvement, or operation of any projects.       (b) Property may be acquired under subsection (a): (1) upon the terms; and (2) at the price or rent; that the commission considers reasonable and that are agreed upon by the commission and the owner.       (c) The commission may acquire land and other interests in real property under subsection (a) by: (1) gift or bequest; or (2) condemnation under section 17 of this chapter.       (d) The commission shall take and hold title to the land and other interests in the name of the state of Indiana.
