Sec. 1. (a) A person may not start: (1) construction of a confined feeding operation; or (2) expansion of a confined feeding operation that increases: (A) animal capacity; or (B) manure containment capacity; or (C) both; without obtaining the prior approval of the department. (b) A person may not operate a confined feeding operation without obtaining the prior approval of the department. [Pre-1996 Recodification Citation: 13-1-5.7-2.]
