Sec. 1. A person may not: (1) construct or operate a nuclear powered generating facility or nuclear fuel reprocessing plant; or (2) increase the capacity of such an existing facility; without a permit from the department. [Pre-1996 Recodification Citation: 13-7-9-1(a).]
