Sec. 122. "Major modification", for purposes of IC 13-15-4 , when applied to a solid waste permit, means any change in a permitted solid waste facility that would: (1) increase the facility's permitted capacity to process or dispose of solid waste by the lesser of: (A) more than ten percent (10%); or (B) five hundred thousand (500,000) cubic yards; or (2) change the permitted footprint of the landfill by more than one (1) acre.
