Ultimate authority; finality of orders

Sec. 8. (a) The secretary is the ultimate authority under IC 4-21.5 for Medicaid applicants and recipient eligibility appeals.       (b) For a Medicaid applicant eligibility case, in the absence of an objection or notice under IC 4-21.5-3-29 (d), the order from the administrative law judge is final after sixty-one (61) days without further affirmation from the ultimate authority.   IC 12-15-29 Chapter 29.
