Sec. 3. (a) Before a person may transport high level radioactive waste in Indiana, the shipper must submit the following to the director: (1) An appropriate permit issued under section 2.9 of this chapter. (2) The following fees: (A) For each truck shipment, two thousand five hundred dollars ($2,500) per truck. (B) For each rail shipment: (i) four thousand five hundred dollars ($4,500) for the first cask; and (ii) three thousand dollars ($3,000) for each additional cask. (b) The director shall deposit fees collected under this section in the nuclear response fund established by section 6 of this chapter. (c) As used in this section, "cask" means a heavily shielded container: (1) used for the shipment of radioactive materials, including high level radioactive waste and spent nuclear fuel; and (2) whose design is approved by the United States Nuclear Regulatory Commission.
