Real estate appraisers.

(a) The term "employment" does not include services performed by an
individual as a real estate appraiser under a written independent contractor
agreement if the agreement provides that:

 
 
(1) The individual shall be compensated on a fee per 
 
appraisal basis; and

 
 
(2) The individual is free to accept or reject 
 
appraisal requests made by the person for whom the services are being performed, or the individual is not prohibited from contracting to perform those services for a person other than the person for whom the services are being performed, or both.

 
(b) Subsection
(a) shall not apply to any services that are required to be covered as a
condition of approval of this Act by the United States Secretary of Labor under
Section 3304(a)(6)(A) of the Federal Unemployment Tax Act.
