Subject to Section 3.5 and Section 9(l), a declaration under this Act becomes operative when all of the following conditions have been met: (1) it has been validly executed; (2) it has not been revoked in accordance with Section 5; (3) the patient is unable to give directions regarding the use of life-sustaining or death delaying procedures; and (4) the patient is a qualified patient. An operative and unrevoked living will declaration continues in effect until revoked in accordance with this Act. Section 5; regarding the use of life-sustaining or death delaying procedures; and
