Consulting physician responsibilities.

Sec. 40. 
Consulting physician responsibilities. 
A consulting physician shall:
 
 
(1) conduct an evaluation of the patient and review 
 
the patient's relevant medical records, including the evaluation pursuant to Section 45, if such evaluation was necessary; 
 
 
(2) confirm in writing to the attending physician 
 
that the patient:
 
 
 
(A) has requested a prescription for aid-in-dying 
 
 
medication;
 
 
 
(B) has a documented terminal disease;
 
 
 
(C) has mental capacity or has provided 
 
 
documentation that the consulting health care professional has referred the individual for further evaluation in accordance with Section 45; and
 
 
 
(D) is acting voluntarily, free from coercion or 
 
 
undue influence.
