(1) All certificates of title shall be printed upon safety paper to be selected by the department, and shall be in such form as the department shall prescribe. (2) When substantiated by a written agreement as provided in section 49-505 , Idaho Code, the department may create a paperless electronic record of a certificate of title in place of issuing a paper document whenever a lien is to be recorded; however, upon written demand from the owner and payment of the fee as provided in subsection (2)(b) of section 49-202 , Idaho Code, the department shall issue a paper certificate of title. (3) In the absence of a certificate of title, the computer records of the department shall be the original title document.
