It is hereby declared to be unlawful, unfair competition and an act or acts within the purview of section 48-406 , Idaho Code, for any manufacturer, wholesaler or retailer to advertise for sale, offer for sale or sell any goods, wares or merchandise where the advertisement contains any assertion, representation or statement which is untrue, deceptive or misleading or falsely represents the kind, classification, grade of quality of the goods, wares or merchandise so advertised.
