(a) The commission may prescribe rules governing the procedure before it, subject to the provisions of the administrative procedure act, chapter 52, title 67 , Idaho Code. (b) In all cases where (1) there is an application for the entry of a pooling order or (2) there is an application for an exception from an established well spacing pattern or (3) a complaint is made by the commission or any party that any provision of this act, or any rule or order of the commission is being violated, notice of the hearing to be held on such application or complaint shall be served on the interested parties in the same manner as is provided in the rules of civil procedure for the service of summons in civil actions. (c) The commission may act upon its own motion, or upon the petition of any interested person. On the filing of a petition for a hearing concerning any matter within the jurisdiction of the commission, it shall promptly fix a date for a hearing thereon and shall cause notice of the hearing to be given. The hearing shall be held without undue delay after the filing of the petition. Proceedings before the commission and judicial review of actions taken by the commission pursuant thereto shall be governed by the provisions of chapter 52, title 67 , Idaho Code. Any person affected by an order of the commission shall have the right at any time to apply to the commission to repeal, amend, modify, or supplement the same.
