Each person discharged from the Idaho military who is later charged with having fraudulently obtained his discharge is, subject to the applicable statute of limitations, subject to trial by court-martial on that charge and is, after apprehension or the service of charges required by section 46-1123 , Idaho Code, whichever occurs first, subject to this code for that trial.
