Cease and desist.

Upon a finding that any action of an international banking corporation or its international banking agency, international banking branch, or international representative office subject to this chapter may be in violation of any Idaho banking law, the director, pursuant to chapter 52, title 67 , Idaho Code, and after a reasonable notice to the international banking corporation, international bank agency, international bank branch, or international representative office and an opportunity for it to be heard, may order it to cease and desist from the action. If the international banking corporation, international bank agency, international bank branch, or international representative office fails to appeal the decision in accordance with chapter 52, title 67 , Idaho Code, and continues to engage in the action in violation of the director's order to cease and desist the action, it is subject to a penalty of one thousand dollars ($1,000) to be recovered with costs by the director in any court of competent jurisdiction in a civil action prosecuted by the director. This penalty is in addition to and not in lieu of any other law applicable to the failure of an international banking corporation, international bank agency, international bank branch, or international representative office to comply with an order of the director.
