(a) (1) On and after July 1, 2023, the Department of Transportation shall participate in and cooperate with the UPC for purposes of receiving locate requests in the Department of Transportation's right of way for underground facilities following a process consistent with Code Sections 25-9-6 , 25-9-7 , and 25-9-8 and subsection (a) of Code Section 25-9-9 . (2) The Department of Transportation shall not be subject to the provisions of subsection (b) of Code Section 25-9-9 or the enforcement provisions of subsections (h) and (i) of Code Section 25-9-14 . (3) The Department of Transportation shall not participate in the funding of the UPC or its activities. (b) Nothing in this chapter shall be construed to deem the Department of Transportation to be a utility owner or a utility provider. Added by 2022 Ga. Laws 777,§ 1, eff. 9/1/2022.
