Law enforcement personnel authorized to conduct drug tests on inmates and releasees

(1) Any law enforcement officer, state or county probation officer, employee of the Department of Corrections, or employee of a contracted community correctional center who is certified by the Department of Corrections pursuant to subsection (2) may administer a urine screen drug test to: (a) Persons during incarceration; (b) Persons released as a condition of probation for either a felony or misdemeanor; (c) Persons released as a condition of community control; (d) Persons released as a condition of conditional release; (e) Persons released as a condition of parole; (f) Persons released as a condition of provisional release; (g) Persons released as a condition of pretrial release; or (h) Persons released as a condition of control release. (2) The Department of Corrections shall develop a procedure for certification of any law enforcement officer, state or county probation officer, employee of the Department of Corrections, or employee of a contracted community correctional center to perform a urine screen drug test on the persons specified in subsection (1).
