Injunctions

(1) In addition to the penalties and other enforcement provisions of this part, the office may seek both temporary and permanent injunctive relief when: (a) A discount plan is being operated by any person or entity that is not licensed pursuant to this part. (b) Any person, entity, or discount plan organization has engaged in any activity prohibited by this part or any rule adopted pursuant to this part. (2) The venue for any proceeding brought pursuant to this section shall be in the Circuit Court of Leon County. (3) The office’s authority to seek injunctive relief is not conditioned on having conducted any proceeding pursuant to chapter 120.
