(1) The applicant for license or the applicant for examination shall appear in person and personally take the examination for license at the time and place specified by the department or by a person designated by the department. (2) The examination shall be conducted by an employee of the department or a person designated by the department for that purpose. (3) The questions propounded shall be as prepared by the department, or by a person designated by the department for that purpose, consistent with the applicable provisions of this code. (4) All examinations shall be given and graded in a fair and impartial manner and without unfair discrimination in favor of or against any particular applicant. (5) The department may provide licensure examinations in Spanish. When determining whether it is in the public interest to allow the examination to be translated into and administered in Spanish, the department shall consider the percentage of the population who speak Spanish.
