The following words and phrases shall have the meaning ascribed to them in this chapter unless the context clearly indicates otherwise:
(1) "Activity" means construction, operation or use of any facility, site, property or device.
(2) "Commission" means the Commission on the Transportation of Hazardous Materials.
(3) "Department" means the Department of Natural Resources and Environmental Control of the State.
(4) "Disposal" means the discharge, deposit, injection, dumping, spilling, leaking or placing of any hazardous waste into or on any
land, water or into the air so that such hazardous waste or any constituent thereof may enter the environment to be emitted into the air,
or discharged into any water, including groundwaters, or any other management of hazardous wastes in which the handler voluntarily
relinquishes control of the waste in a manner inconsistent with the requirements of this chapter and the regulations promulgated
thereunder.
(5) "Division" means the Division of Waste and Hazardous Substances.
(6) "Generation" means the act or process of producing hazardous waste materials.
(7) "Hazardous waste management" means the systematic control of the collection, source separation, storage, transportation,
processing, treatment, recovery and disposal of hazardous waste.
(8) "Hazardous wastes" means a solid waste, or combination of solid wastes, which because of its quantity, concentration, or physical
or chemical characteristics may cause or significantly contribute to an increase in mortality or an increase in serious irreversible, or
incapacitating irreversible illness, or pose a substantial present or potential hazard to human health or the environment when improperly
treated, stored, transported or disposed of, or otherwise managed.
(9) "Manifest" means the form used for identifying the quantity, composition, origin, routing and destination of hazardous waste
during its transport.
(10) "Person" means an individual, trust, firm, joint stock company, federal agency, corporation (including a government
corporation), partnership, association, state, municipality, commission, political subdivision of a state or any interstate body.
(11) "Secretary" means the Secretary of the Department of Natural Resources and Environmental Control, or his or her duly
authorized designee.
(12) "Solid waste" means any garbage, refuse, sludge from a waste treatment plant, water supply treatment plant or air pollution
control facility and other discarded material, including solid, liquid, semisolid or contained gaseous material resulting from industrial,
commercial, mining and agricultural operations, and from community activities, but does not include solid or dissolved material in
domestic sewage, or solid or dissolved materials in irrigation return flows or industrial discharges which are point sources subject to

permits under Chapter 60 of this title, as amended, or source, special nuclear or by-product material as defined by the Atomic Energy
Act of 1954 [42 U.S.C. 2011 et seq.], as amended.
(13) "Storage" means the containment of hazardous wastes, either on a temporary basis or for a period of years, in such manner as
not to constitute disposal of such hazardous wastes.
(14) "Transfer facility" means any transportation-related facility including loading docks, parking areas, storage areas and other
similar areas where shipments of hazardous waste are held during the normal course of transportation.
(15) "Transport" means the movement of wastes from the point of generation to the point of storage, treatment or disposal.
(16) "Treatment" means any method, technique or process, including neutralization, designed to change the physical, chemical or
biological character or composition of any hazardous waste, so as to neutralize such waste or so as to render such waste nonhazardous,
safer for transport, amenable to recovery, amenable to storage or reduced in volume.
(17) "Treatment facility" means a location at which waste is subjected to treatment and may include a facility upon premises where
hazardous waste has been generated.
