Filing of records of drilling; confidential nature of records

(a) Records of drilling conducted by a permittee under § 6104 of this title shall be retained by the permittee and be made available to the
Secretary and the State Geologist upon their request. Any such records which the permittee is required to make available to the Secretary
or the State Geologist shall be for the confidential use of the Secretary and the State Geologist and shall not be open to inspection by any
other person or agency without the written consent of the permittee.
(b) The Secretary may require, as a condition to the issuance of any lease under this chapter, that the lessee make available to the
Secretary or the State Geologist upon request, all factual and physical exploration results, logs and records resulting from the operations
under the lease. Any such factual or physical exploration results, logs or records which the lessee is required to make available to the
Secretary or the State Geologist shall not be open to inspection by any other person or agency without the written consent of the lessee.
