Removal of shellfish; presumptions

(a) It shall be unlawful for any person to take, carry away or remove shellfish or equipment from shellfish grounds leased, pursuant
to this chapter, to a person other than himself or herself. If convicted, said person shall be guilty of grand or petty larceny according to
the value of shellfish or equipment in question.

(b) For the purpose of determining the value of shellfish unlawfully removed, all shellfish found on board a vessel utilized in the
removal of shellfish from grounds leased to another shall be presumed to have been unlawfully removed from those leased grounds.
(c) Any vessel on or over grounds leased to another shall be presumed to be removing shellfish from those grounds if that vessel has
overboard at that time any device used for the taking of shellfish.
