(a) A person who violates this chapter is subject to a civil penalty as follows: (1) For a first occurrence, a civil penalty in an amount that does not exceed $100. (2) For a subsequent occurrence, a civil penalty in an amount that does not exceed $250. (b) Before imposing a penalty under subsection (a) of this section, the Secretary must send a written notice of the violation and offer the person an administrative hearing. (c) The Attorney General shall institute proceedings at once against any person charged with a violation of this chapter. (d) After judgment by the court in any case arising under this chapter the Department shall publish any information pertinent to the issuance of the judgment by the court in such media as it may designate from time to time.
