(a) In addition to the penalties and other enforcement provisions of this chapter, the Commissioner may seek both temporary and permanent injunctive relief when: (1) A discount medical plan is being operated by a person or entity that is not licensed pursuant to this chapter; or (2) Any person, entity or discount medical plan organization has engaged in any activity prohibited by this chapter or any regulation adopted pursuant to this chapter. (b) The venue for any proceeding brought pursuant to this section shall be in the Delaware Court of Chancery. (c) The Commissioner's authority to seek injunctive relief is not conditioned on having conducted any proceeding pursuant to Chapter 101 of Title 29.
