Whoever wilfully damages or injures any public road, bridge, drain, light, gate or other appurtenance used and maintained for the safety or convenience of the traveling public shall be fined not more than $500. However, if the damage or injury was on or along a "Delaware byway," as defined in § 101 of this title, an additional civil mandatory penalty of $500 must be added to the fine. The fine and civil penalty, upon the collection thereof, shall be paid to the State Treasurer. (Code 1852, § 1131; Code 1915, § 1573; 29 Del. Laws, c. 108; 40 Del.
