(a) All information received by the Department of Education, or any third party performing work for the Department of Education, relating to the dates on which new teachers are hired by individual school districts shall be posted on the Department of Education's web site. (b) The Department of Education shall conduct randomized audits to ensure that information provided by school districts relating to the hiring dates of new teachers is accurate and complete. (c) By August 12, 2011, the Department of Education shall promulgate regulations necessary to ensure that hiring information collected and reported by school districts uses uniform terminology. (d) By December 31, 2011, the Department of Education shall report to the General Assembly and Governor on the impact of the estimated unit count upon school districts' performance in making earlier contract offers to prospective teachers. To the extent that the Department of Education determines that any districts have not taken proper advantage of the estimated unit count, the Department shall recommend additional steps that should be taken to properly incentivize those districts to make earlier contract offers. (e) For purposes of §§ 1321(e)(11) and (e)(12), 1716 and 1716A of this title, a school district electing to take a cash option or contractual option shall submit an application to the Department of Education no later than January 31 of each fiscal year. The Department of Education shall provide a report on the use of said cash/contractual options to the Director of the Office of Management and Budget and the Controller General by May 1 of each fiscal year.
