Unless a surrogacy agreement expressly otherwise provides: (1) (A) The marriage of a person acting as surrogate after the surrogacy agreement is signed by all parties shall not affect the validity of the surrogacy agreement, (B) the consent of the spouse of the person acting as surrogate is not required, and (C) the spouse of the person acting as surrogate is not a presumed parent of a child conceived by assisted reproduction under the surrogacy agreement; and (2) The divorce, dissolution, annulment, declaration of invalidity, legal separation or separate maintenance of the person acting as surrogate after the surrogacy agreement is signed by all parties shall not affect the validity of the surrogacy agreement.
