Cheating game and devices - penalty

(1) It is unlawful for a person
playing a licensed game in licensed gaming premises to:
(a) Knowingly conduct, carry on, operate, or deal or allow to be conducted, carried on,
operated, or dealt any cheating or thieving game or device; or
(b) Knowingly deal, conduct, carry on, operate, or expose for play a physical or
electronic version of a game played with physical or electronic cards or a mechanical device, or
any combination of games or devices, that have been marked or tampered with or placed in a
condition or operated in a manner that tends to deceive the public or alter the normal random
selection of characteristics or the normal chance of the game, or that could determine or alter the
result of the game.
(2) A person violating any provision of this section commits a class 6 felony and shall be
punished as provided in section 18-1.3-401.
