Colorado Code § 43-1-103

(1) There is hereby created the
department of transportation, the head of which shall be the executive director of the department
of transportation, which office is hereby created. The executive director shall be appointed by
the governor with the consent of the senate and shall serve at the pleasure of the governor.
(2) The office of the executive director shall include the office of transportation safety
created in section 24-42-101, C.R.S.
(3) The executive director shall prepare and transmit annually, in the form and manner
prescribed by the heads of the principal departments pursuant to the provisions of section 24-1-
136, C.R.S., a report accounting to the governor and the general assembly for the efficient
discharge of all responsibilities assigned by law or directive to the department and the divisions
thereof.
(4) Publications by the executive director circulated in quantity outside the executive
branch shall be issued in accordance with the provisions of section 24-1-136, C.R.S.
