Contributions credited to Colorado domestic abuse program fund - creation - appropriation

(1) The department of revenue shall determine annually the total
amount designated pursuant to section 39-22-801 and shall report such amount to the state
treasurer. The state treasurer shall credit such amount to the Colorado domestic abuse program
fund, a cash fund hereby established in the state treasury. The controller, upon presentation of
vouchers properly drawn and signed by the executive director of the department of human
services, pursuant to section 26-7.5-105, shall issue warrants drawn on the Colorado domestic
abuse program fund. All money in the Colorado domestic abuse program fund at the end of a
fiscal year, after appropriations made pursuant to subsection (3) of this section, shall remain in
the fund to be used for the purposes set forth in article 7.5 of title 26 and shall not revert to the
general fund. Any interest derived from the deposit and investment of money in the fund shall
remain in the fund to be used for the purposes of article 7.5 of title 26, except as otherwise
provided in section 24-75-226 (4)(c)(II).
(2) The executive director of the department of human services shall sign vouchers to
draw on the Colorado domestic abuse program fund exclusively for the purpose of exercising his
authority under section 26-7.5-104, C.R.S.
(3) The general assembly shall appropriate annually from the Colorado domestic abuse
program fund:
(a) To the department of human services such amount as is necessary for carrying out
the purposes set forth in article 7.5 of title 26, C.R.S., including the department's administrative
costs in connection therewith;
(b) To the department of revenue its costs of administering the income tax refunds
designated as contributions to the fund.
(4) Notwithstanding any provision of subsection (1) of this section to the contrary, on
June 30, 2011, the state treasurer shall deduct two hundred thousand dollars from the Colorado
domestic abuse program fund and transfer such sum to the general fund. The transfer required by
this subsection (4) shall be from moneys deposited in the Colorado domestic abuse program fund
that were generated from fees collected pursuant to sections 13-32-101 (1)(a) and (1)(b) and 14-
2-106 (1)(a), C.R.S., and such transfer shall not include any moneys that were voluntary
contributions received pursuant to section 39-22-801.
