Land commissioners' receipts - appropriation

(1) All moneys collected by
the state board of land commissioners shall be deposited with the state treasurer. Moneys
received by the state board of land commissioners for fees and services shall be credited by the
state treasurer to the state board of land commissioners land and water management fund created
in section 36-1-148. All other moneys deposited by the state board of land commissioners shall
be credited by the state treasurer to the proper funds as provided by law.
(2) (a) The state land board trust administration fund is hereby created in the state
treasury for the purposes specified in paragraph (b) of this subsection (2).
(b) The general assembly shall annually appropriate moneys from the state land board
trust administration fund sufficient to pay for the salaries of employees of the state board of land
commissioners and expenses and per diem allowances of commissioners and all other expenses
incurred in administering the provisions of articles 1 to 7 of this title and sections 9 and 10 of
article IX of the Colorado constitution. Each land grant administered by the state board of land
commissioners shall be charged with the expense of its administration.
(c) Any moneys remaining in the state land board trust administration fund at the end of
the state fiscal year shall be allocated to the trust funds under the control of the state board of
land commissioners in an amount equal to the proportion of such moneys that would have been
paid into such trust funds but for their allocation to the state land board trust administration fund;
except that moneys in the financial warranty account of the fund created in paragraph (e) of this
subsection (2) shall remain in the account until spent.

(e) There is hereby created in the state land board trust administration fund the financial
warranty account, consisting of financial warranties credited to the account pursuant to section
36-1-129 (3). The board shall expend moneys in the account only for purposes specified in
section 36-1-129 (3).
(3) The general assembly shall allocate moneys to the state land board trust
administration fund from the income generated by the state trust lands. The allocations to the
fund and the appropriations to the state board of land commissioners shall be sufficient to enable
the state board of land commissioners to perform its duties.
