Sale of lands to procure irrigation

(1) and (2) Repealed.
(3) If any person, other than the person making application for the purchase of the lands,
is the highest bidder at the public sale thereof, such bidder shall, within such reasonable time as
the board may fix, enter into a contract and bond, as required by the provisions of this article, for
the construction of the ditch and for the furnishing of water therefrom; and, in the event of his
failure to furnish a satisfactory bond and enter into the said contract within the time fixed, then
such bid shall be disregarded, and such public sale shall be void and of no effect. The board shall
make the sale upon like conditions as other state lands are sold, and shall require a good and
sufficient bond from the party desiring to construct such ditch, conditioned upon the faithful
performance of the contract, and the conditions of the sale, and in no case shall the title to any of
said lands pass from the state until the ditch has been completed and accepted by the board.
