Injunctive proceedings

(1) The department may, through the attorney
general of the state of Colorado, apply for civil penalties and for an injunction to enjoin any
person from committing any act declared to be unlawful by this article. Such application shall be
heard in the district court of the county in which the grounds for the action arose.
(2) In such proceedings, if the court enters a temporary restraining order, preliminary
injunction, or permanent injunction or awards civil penalties, the person against whom such
injunctive order was entered or against whom such civil penalties were awarded shall pay the
costs of the proceeding, including reasonable attorney fees.
