Enterprise status of commission and division

(1) The division and the
commission constitute an enterprise for the purposes of section 20 of article X of the state
constitution, so long as the commission retains the authority to issue revenue bonds and the
division receives less than ten percent of its total annual revenues in grants, as defined in section
24-77-102 (7), C.R.S., from all Colorado state and local governments combined. So long as they
constitute an enterprise pursuant to this section, the division and the commission are not subject
to any of the provisions of section 20 of article X of the state constitution.
(2) The enterprise created pursuant to this section has all the powers and duties of the
commission and the division as authorized under this title.
(3) Nothing in this section limits or restricts the authority of the division to expend its
revenues consistent with this title.
