Limitations on the disposal of tires

(1) (a) Except as specified in
paragraph (b) of this subsection (1), a person shall dispose of waste tires only by delivery to a
generator engaging in waste tire collection, to a waste tire processor, to a waste tire monofill, or
to a waste tire collection facility.
(b) If a person is able to establish that due diligence has been conducted and no
reasonable option for disposing of a waste tire as specified in paragraph (a) of this subsection (1)
is available, then the person may dispose of the waste tire in a solid wastes disposal site and
facility or transfer station.
(2) A waste tire generator and an owner or operator of a waste tire collection facility
shall arrange for the commercial hauling of waste tires only with a hauler who is currently
registered pursuant to section 30-20-1408.
(3) Each waste tire improperly disposed of constitutes a separate violation.
