Used tire management

(1) A person who accumulates, stores, transports,
or dispenses used tires shall:
(a) (I) Develop written criteria for distinguishing waste tires from used tires, maintain
the criteria on site, and make the criteria available for inspection;
(II) Clearly identify waste tires and used tires according to the criteria developed
pursuant to subparagraph (I) of this paragraph (a);
(b) (I) Develop written criteria for distinguishing used tires being held for sale in
Colorado from used tires being held for sale outside Colorado, maintain the criteria on site, and
make the criteria available for inspection;
(II) Clearly identify used tires being held for sale in Colorado and used tires being held
for sale outside Colorado according to the criteria developed pursuant to subparagraph (I) of this
paragraph (b); and
(c) Organize used tires for sale in a manner that allows the inspection of each individual
tire.
(2) A person shall not sell a used tire if doing so would violate any of the conditions
listed in section 42-4-228, C.R.S.
(3) The department may issue a waiver relating to any requirement of this section.
