Certificate - state financial assurance requirements

(1) If the governing
body having jurisdiction deems that a certificate of designation should be granted to the
applicant, it shall issue the certificate, and such certificate shall be displayed in a prominent
place at the site and facility. Such governing body shall not issue a certificate of designation if
the department has recommended disapproval pursuant to section 30-20-103.
(2) No governing body having jurisdiction shall require an applicant for a certificate of
designation to obtain any financial assurance mechanism or amount in addition to that required
by the provisions of section 30-20-104.5.
(3) The department, on behalf of the solid and hazardous waste commission, shall
consult the governing body having jurisdiction prior to the promulgation of the rules called for in
this section and prior to accepting a financial assurance. The recommendations of such
governing body shall be considered in formulating the rules and establishing the amount of
financial assurance to be posted.
