Records of persons with substance use disorders, persons intoxicated by alcohol, and persons under the influence of substances

(1) The registration and other records
of treatment facilities are confidential and fully protected as outlined in federal confidentiality
regulations for substance use disorder records found at 42 CFR part 2, as amended, and are
privileged to the patient.
(2) Notwithstanding subsection (1) of this section, the commissioner may make available
information from patients' records for purposes of research into the causes and treatment of
substance use disorders. Information made available pursuant to this subsection (2) must not be
published in a way that discloses patients' names or other identifying information.
(3) Nothing in this section prohibits or limits the sharing of information by a state
institution of higher education police department to authorized university administrators
pursuant to section 23-5-141.
