Employee and contracted service provider - criminal history record

check. A behavioral health entity shall require an applicant seeking employment with, or seeking
to contract to provide services for, the behavioral health entity to submit to a criminal history
record check before employment or execution of a contract. The behavioral health entity shall
pay the costs of the criminal history record check. The criminal history record check must be
conducted not more than ninety days before the employment of or contract with the applicant.
