Public assistance in the form of social services

(1) Subject to available
appropriations, the state department may provide those services required by the social security
act and applicable federal regulations. Subject to available appropriations, the state department
may, by regulation, elect to provide those services which are optional under the social security
act.
(2) Eligible persons shall include those required to be eligible for services by the social
security act and federal regulations. Subject to available appropriations, eligible persons may
include those persons who are optionally eligible under federal law and regulations whom the
state department, by regulation, includes as eligible persons.
(3) The state department shall adopt budgetary standards from which a graduated
schedule of fees shall be determined. Said fees shall be paid by persons who receive social
services and who have the financial ability to pay in accordance with the schedule of fees
established by the state department.
(4) The state department shall prepare and submit to the secretary of the federal
department of health and human services a state plan for services that meets the requirements of
the social security act, federal regulations, and this section. The state department shall administer
the program for services in accordance with the social security act, federal regulations, and this
section.
