Required compliance in building codes

(1) (a) Repealed.
(b) On and after January 1, 1993, every board of county commissioners of a county in
the AIR program area which has enacted a building code, and thereafter every board of county
commissioners of a county in the AIR program area which enacts a building code, shall,
pursuant to section 30-28-201 (2), C.R.S., adopt a building code provision requiring any person
who installs or constructs any fireplace to comply with section 25-7-407 (8).
(2) (a) Repealed.
(b) On and after January 1, 1993, every governing body of a municipality in the AIR
program area which has enacted a building code, and thereafter every governing body of a
municipality in the AIR program area which enacts a building code, shall, pursuant to section
31-15-601 (2), C.R.S., adopt a building code provision requiring any person who installs or
constructs any fireplace to comply with section 25-7-407 (8).
(3) Nothing in this article 7 prevents a board of county commissioners or a governing
body of a municipality from enacting a building code that requires more stringent standards for
wood stoves and for fireplaces, if such standards are necessary and reflect technology suitable
for commercial application within the meaning of section 25-7-407 (1), as that section existed
prior to its repeal in 1993.
