Appropriate treatment and disposal - nonliability

(1) A generator of
infectious waste using an appropriate treatment method with appropriate documentation as
provided in section 25-15-404 (2) and, in good faith, utilizing disposal facilities for such waste
shall not be civilly or criminally liable for injuries or damages allegedly resulting from the
infectious character of such waste; except that any generator who does not use an appropriate
treatment method or any generator who fails to utilize disposal facilities in good faith shall not
be relieved of civil or criminal liability.
(2) When any infectious waste has been appropriately treated, the generator shall either
identify it as such or provide the hauler and disposal facility with a written statement that its
general waste includes infectious waste which has been appropriately treated to render it
noninfectious.
