Local control of facilities - authorization by department - allocation of

fees. The department may enter into an agreement with a county, a city and county, or a
municipality within whose jurisdiction is located one or more hazardous waste treatment,
storage, or disposal sites or facilities for such local government to provide inspection,
monitoring, and emergency response for such sites and facilities. The department shall make
available to any such local government a reasonable portion of the fees appropriated from the
hazardous waste service fund for conducting such functions. The department shall have the
power to reassume any such function granted a local government if it appears to the department
that the appropriate expertise is unavailable or that the resources provided are not appropriately
applied for the agreed purpose, or if the department and the local government mutually so agree.
