Railroad loan retirement fund - fees

(1) The Cumbres and Toltec scenic
railroad commission may establish user fees to be charged to passengers on the railroad. The fee
schedule may provide for different fees for different classes of passengers.
(2) All railroad fees collected pursuant to subsection (1) of this section shall be deposited
into a railroad loan retirement fund, which fund shall be established in an appropriate financial
institution. The commission may authorize the investment of moneys in the fund, and any
income earned from such investment shall be retained in the fund. The moneys in the fund shall
be used to repay any debts incurred by the commission pursuant to section 24-60-1906. While
such debts are outstanding, the commission shall not reduce or eliminate any user fees that were
in effect at the time the debt was incurred.
