Confidentiality

(1) All information contained in records of members,
former members, inactive members, DPS members, DPS retirees, benefit recipients and their
dependents, including those from the Denver public schools division, participants in the
voluntary investment program established pursuant to part 14 of this article, participants in the
defined contribution plan established pursuant to part 15 of this article, and participants in the
deferred compensation plan established pursuant to part 16 of this article shall be kept
confidential by the association.

(3) Information regarding real estate, private equity, private debt, timber, and mortgage
investments by the association may be kept confidential until the transaction is completed if it is
determined by the board that disclosure of such information would jeopardize the value of the
investment; except that the association may disclose such information to legislative members of
the pension review commission created in article 51.1 of this title 24 while the commission is
meeting in executive session. If the association cannot disclose such information without
violating confidentiality provisions, then the association shall provide enough information to the
legislative members of the commission, while the commission is meeting in executive session, to
inform the legislators regarding whether such investments continue to be in the public interest.
