Survivor benefits - refund

(1) The determination of death and survivor
benefits for DPS members shall be governed by this section. Pursuant to the provisions of this
part 17 regarding portability, references in this section to service with the district shall be
deemed to include service with all employers affiliated with the association.
(2) In case of death of any affiliate or contributing member prior to retirement, the total
accumulated contribution balance at the time of death shall be payable in one lump sum to the
designated beneficiary, if applicable, or to the member's estate, unless one or more of the
following circumstances exist:
(a) Said member meets the definition of deferred member under section 24-51-1702
(19)(e) at the time of death, in which case section 24-51-1730 shall apply.
(b) The designated beneficiary or beneficiaries of said member shall elect, pursuant to
the provisions of sections 24-51-1736 to 24-51-1746, to have the provisions of said sections 24-
51-1736 to 24-51-1746 applied in lieu of the refund above mentioned.
