(1) All offices in the executive and judicial
departments of the state government shall be and remain open for business daily, except on
Saturdays, Sundays, and legal holidays, from the hour of 8:30 a.m. until the hour of 5:00 p.m.;
except that nothing in this section shall affect the validity of any act performed by either of said
departments before or after the hours specified in this section.
(2) Notwithstanding the provisions of subsection (1) of this section, when a city or city
and county and the suburban area within a ten-mile radius of the boundaries thereof have a
population in excess of fifty thousand inhabitants, the offices of any executive department of the
state government located therein may vary its business hours from those indicated in subsection
(1) of this section whenever the executive director of the principal department, with the approval
of the governor, determines that such adjustment of hours will help alleviate peak traffic
conditions and provide a more even flow of traffic for the purpose of creating safer highway
conditions.
(3) Written notice of the variance permitted under subsection (2) of this section shall be
given to the local news media of such cities or cities and counties not less than two weeks
preceding the effective date of such variance.
(4) Employees in the state personnel system who are required to work on general
election day during the hours the polls are open pursuant to section 1-7-101, C.R.S., shall be
granted two hours' administrative leave in which to vote pursuant to the provisions of section 1-
7-102, C.R.S. The state personnel director shall promulgate rules in accordance with article 4 of
this title for the implementation of this subsection (4).
